1. Agreement

By creating an account or using Museum Companion ("the App"), you agree to these Terms. If you do not agree, do not use the App. The App is operated by Museum Companion ("we", "us").

2. Who may use the App

You must be at least 13 years old, or the minimum age of digital consent where you live, whichever is higher. If you are under 18, you need a parent or guardian's permission.

3. Your account

You are responsible for keeping your password confidential and for everything that happens under your account. Tell us at museumcompanionapp@gmail.com if you believe your account has been compromised.

4. What the App does, and what it does not

The App uses artificial intelligence to identify artworks from photos you take and to generate descriptions of them.

AI-generated descriptions can be wrong. Identifications may be incorrect, attributions may be mistaken, and historical detail may be inaccurate or incomplete. The App is a companion for personal enjoyment and learning. It is not a scholarly source, an appraisal, an authentication, or advice of any kind. Do not rely on it for academic, commercial, insurance, or provenance purposes.

5. Acceptable use

You agree not to:

• photograph people in a way that invades their privacy, or use the App to identify individuals;
• ignore a museum's rules on photography, flash, or device use;
• upload content that is illegal, or that you have no right to capture or share;
• attempt to reverse engineer, scrape, overload, or circumvent rate limits on the App or its servers;
• resell, redistribute, or bulk-extract the App's generated content.

We may suspend accounts that break these rules.

6. Content and intellectual property

Artworks and their images remain the property of their creators, owners, and rights holders. Nothing in the App transfers any rights in them to you. The App itself, its design, and its software are ours.

You keep any rights you have in the photos you take. You grant us a limited licence to transmit and process those photos solely to generate a description for you, as described in the Privacy Policy.

7. Availability and changes

The App depends on third-party services and may be unavailable, interrupted, or changed at any time. We may add, alter, or remove features. We may introduce usage limits or paid tiers, with notice for any change that affects a paid feature.

8. Termination

You may delete your account at any time from Settings, which permanently removes your account data. We may suspend or terminate your access if you breach these Terms or if we stop offering the App.

9. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent the law allows.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on AI-generated content. Our total liability for any claim relating to the App is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 50.

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

11. Changes to these Terms

We may update these Terms. If a change is material, we will notify you in the App or by email before it takes effect. Continuing to use the App after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of North Macedonia, without regard to conflict-of-law rules. This does not remove any mandatory consumer protections you have where you live.
